CWU member Proposal

The members of CWU have full confidence in our President, who is heading up our team to get the best possible deal for us. The SABC has now realised how important we are as workers.

The moment we receive news, we shall post it here. Keep checking in, comrades.

We have been informed that the negotiations are going very well - our struggle will pay off, comrades. Well done!

1. OBJECTIVE
1.1 To secure the annual general salary adjustment for unionised employees in the Bargaining Unit for the financial year 2009/10, and to secure the SABC's ability to meet its obligations.

2. SCOPE OF APPLICATION

2.1 This agreement will be applicable to Employees who are Members in good standing of Communication Workers Union, within the bargaining unit (scale codes 300-409 and 600).

2.2 The scope of this agreement excludes scale code 900 employees, on condition that they are certified as Bona Fide Ad Hoc Freelancers.

3. SALARY ADJUSTMENT

3.1 CWU members in the bargaining unit will receive ten per cent (10%) salary adjustment across the board (ATB) for the financial year 2009/10, back paid to 1 April 2009 with interest calculated at 10%p.a.

3.2 The referred to salary adjustment and interest payment will be effected within five (5) days of the signing of this agreement.

3.3 A further 2.2% increase, backdated with interest, to 1 April 2009 shall be paid to CWU members by latest 31 January 2010, or soon as the SABC has secured a bail-out package from Government or overdraft facility to enable the payment. The CWU undertakes to assist the SABC in regaining credit health, by supporting a full scale effort at recovering all funds lost due to wasteful expenditure. See 6.4 - 6.7.

4. DATE OF IMPLEMENTATION

4.1 This agreement shall come into effect on the date of signature hereof and shall remain in force until 31 March 2010, unless otherwise agreed to by the parties hereto in writing.

5. STATUS OF AGREEMENT

5.1 This agreement supplements the outstanding agreements previously made on substantive issues.

6. FURTHER AGREEMENTS

The SABC undertakes to:

6.1 Extend the petrol / garage card benefits currently enjoyed by senior management to all CWU members in the Bargaining Unit.

6.2 Extend the DSTV allowances currently enjoyed by Top & Senior Managers to all CWU Members in the Bargaining Unit.

6.3 Equitably make available Newspapers to all employees - no individual deliveries.

6.4 Fully support and comply with the investigation currently being conducted by the Auditor General, but to add 2 extra people on the team:
- 6.4.1 An auditor of the CWU's choice, as well as
- 6.4.2 A democratically elected Trade Union Representative.

6.5 Request the team in 6.4 supra, to review all cases of CWU Shop Stewards who engaged in Collective Bargaining with their management, and was subsequently fired, suspended or disciplined by that same management, with the goals of:
- 6.5.1 Reversing the adverse effects on SABC of such victimisation / silencing, and
- 6.5.2 Making those Shop Stewards and members available to contribute to the investigations.

6.6 Make available to the public, the Shareholder, the Board and the CWU, for inspection, all audit recommendations for the past 10 years, both internal and external.

6.7 Sue and criminally prosecute, where applicable, all employees who is suspected of having fruitlessly and wastefully spent the SABC's money.

6.8 The Team in 6.4 supra, shall transparently, on the last working day of each month, report the progress of wasteful expenditure recovery to the CWU, in order for it to be informed at what point the SABC has the extra R20million to cover the 2.2%.


6.9 If by 1 December 2009, the team in 6.4 supra has not been able to recover at least R20million, the short payment shall then be referred to the Shareholder on that date.

6.9 Re-instate selling of leave with immediate effect, even if the amount of leave days sold is limited to 3 days a month at first.

    Don't nmake the same mistakes Bemawu has made. Please fight that last yers agreement must be honoured. How can that agreement just be ignored by all 3 Unions and Management and new agreements be put in place. We are not happy with what Hannes has done, now you want to do exactly the same to your members!!!! Explain that, please. There is an agreement in place and everybody should recognise and honour that and fight for that. Why accept 10%, where the agreement says 12,2%. We (Bemawu members) are not happy with the totally new agreement which was signed, do you really think your members will be happy with this 1???? Fight for what you now is the right agreement. That is waht we wanted ...

    This does not accept 10%. It simply aids the CWU and other unions in forcing the SABC to find the other 2.2%, via the shareholder and auditor general. It still requires the full 12.2% to be paid according to the agreement. The CWU can see that the only way to do that, is for us to help them recover it from those who spent it.

    Sorry, I meant clause 6.8 "Should, at any time, the team as in 6.4 supra, transparently report that all the above efforts may not enable the parties to this agreement recover enough funds to cover the 2.2% by 31 January, a further agreement will be negotiated on that date." That gives them a way out!

  5. Comrades, the CWU thanks you for your input. Point 6.8 of the proposal has noe been amended to read:
    "Should, at any time, the team as in 6.4 supra, transparently report that all the above efforts may not enable the parties to this agreement recover enough funds to cover the 2.2% by 31 January, the payment claim shall be deferred to the Shareholder on that date."

    This means we are still demanding that either the SABC or its shareholder pays us what was agreed upon. Please comment.

    The above proposal starts at para 3. What has happened to paras 1 and 2? In 2006, we wanted to negotiate substantives. Management agreed to negotiate substantives at a later date!! We agreed, but we have now waited three years to negotiate better substantives, while management has run the SABC into the ground. How many more years do we have to wait before SABC management will commit to improving the lot of the employees who keep them in their jobs?

    I like it, I believe this is a workable way forward. I hope other parties feeling the same. I think 5.1 covers last years multipart?

    No, 5.1 covers the housing, post retirement benefits, car schemes, gym allowance, canteen subsidy, bursaries, and more.

    Cde Ben, please talk to the others to make this include an agreement for next year as well.

    I like that at end January (or before), we may see an extra bit - it is always good after Christmas season.

    There must also please be a clause brought in that keeps a running tally of how much has been retrieved, and how close to (extra 2.2%) target we are. It translates to about R30 million - I can't see aproblem - just repossess about 40 houses.

    COSATU has summed it up very well...

    "Not only are CWU members NOT responsible for the financial meltdown at the SABC, but played a big role in exposing the corruption that led to it".

    This is a stark reminder that the unscrupulous scum that wasted all the funds, are still here. Please let us use this opportunity to get rid of them.

    Also do NOT forget the agreement on housing, post retirement benfits and more they also failed to honour.

    Sies! And sies! on anyone who sells out members, just to score points with a gullable new interim board. Let our experienced WORKER Shop Stewards go tell them what is what!

  16. Comrades - I have forwarded this to the Shop Stewards Council. I am awaiting their comments. Let us hope they understand we are negotiating to be recognised as special and valuable employees, and that they take the our proposal to a full blown democratic ballot.

    If we are going to march, we must do so to defend a Democratic Document.

    Please ensure you show this to other comrades, and ask them to comment, so we can perfect it.

    I don't think it is fair to call the entire council ignorant just because of one or two power hungry individuals on it.

    Most of them are caring individuals who wish only the best for its members, and who spend long hours trying to defend the SABC against the corruption. All in all, I still say CWU and MWASA has superb Shop Stewards, that have made huge differences already.

    This place will never come RIGHT as long as there are people like Benard Koma, Neli Shuping, Dingaan Feliti, Ntsoaki Ramaphosa and GANG.... its a pity because there is a lot of hard working PEOPLE at the SABC ...so called 300 - 411 scaled employees Pity they are the ones who are suffering under the leadership of those USELESS hooligans.
